Terms and Conditions

1. Overview
These Terms & Conditions (“Terms”) govern your use of dreamai.design (the “Website”) and the AI-powered image-generation services (the “Services”) operated by Pictora s.r.o. (Reg. No. 23585404), Tyršova 1838/14, Nové Město, 12000 Praha 2, Czech Republic (“Pictora,” “we,” “us,” or “our”). By accessing or using the Website, you agree to these Terms. If you do not agree, please do not use the Website or Services.
2. What We Provide
dreamai.design enables users to generate images using AI. Two service tiers are available:
- Request (Basic): generate images from your own prompt.
- Premium Request: generate images with additional controls (style, focus, overall tone), and the ability to choose image size and output format (JPEG, PNG, or PDF).
Unless we agree otherwise in writing, the Services are for personal, non-commercial use.
3. Eligibility & Accounts
You must be 18+ (or the age of majority in your location) and have legal capacity to accept these Terms. If you create an account, you must provide accurate information, keep credentials secure, and are responsible for all activity under your account. We may suspend or terminate accounts for misuse or policy violations.
4. Acceptable Use
You agree not to: (a) use the Services unlawfully; (b) upload or generate content that is illegal, hateful, obscene, defamatory, or infringing; (c) violate third-party IP or privacy rights; (d) probe, disrupt, or attempt unauthorized access to our systems; (e) bypass technical or usage limits; (f) reverse-engineer or tamper with the Services. We may remove content and suspend or terminate access for breaches.
5. Orders, Pricing & Payment
You’ll see the current price for each request in the interface before submission. Payment is taken up-front for each Request or Premium Request. Unless stated otherwise, prices are shown in EUR and may include applicable taxes/fees at checkout. We may change prices prospectively. We accept the payment methods shown at checkout. Successful payment generates or queues your order for processing.
6. Delivery & Formats
Outputs are delivered digitally in your account or via download link. Supported formats: JPEG, PNG, PDF (as available in the UI, including size options in Premium Request). If generation fails due to a platform error, we will re-run the job or credit/replace the specific failed request.
7. Cancellations & Refunds
Because generation begins immediately after purchase, orders are generally non-cancellable and non-refundable once processing starts. We will consider a remedy (re-run or replacement) if:
- a platform error results in corrupted or undeliverable output; or
- a verified extended outage prevents delivery.
Refunds are not issued for style preferences or subjective dissatisfaction with results.

Right of Withdrawal for EU Consumers (Including the Czech Republic)
If you are a consumer residing in the European Union, including the Czech Republic, you generally have the right to withdraw from a distance contract within 14 days without giving any reason, pursuant to EU Directive 2011/83/EU on Consumer Rights and applicable provisions of the Czech Civil Code (Act No. 89/2012 Coll.).
By placing an order and expressly requesting that the digital content or service (i.e., AI image generation) commence immediately, you acknowledge and agree that the full performance of the service will occur before the expiry of the 14-day withdrawal period. Consequently, you expressly waive your right of withdrawal once the generation process begins.
If you do not agree to this, please do not confirm your order until you are ready for the service to start.
8. Your Content & Rights
Prompts and Outputs. Subject to any third-party rights and your compliance with these Terms, you own your lawful prompts and outputs you generate.
License to Pictora. You grant us a worldwide, non-exclusive, royalty-free license to host, process, and display your prompts and outputs solely to operate, secure, improve, and support the Services (including quality assurance and abuse prevention).
No originality guarantee. AI outputs may resemble existing works. You are responsible for any checks (e.g., IP clearance, publicity/privacy, regulatory) before publishing or commercial use.
9. Our IP
All software, models, design, trademarks, and other materials on dreamai.design are our or our licensors’ property (“Pictora Materials”). Except for the limited rights in Section 8, no license is granted. You may not copy, modify, distribute, or create derivative works of Pictora Materials without prior written consent.
10. Service Changes
We may add, change, suspend, or discontinue features at any time. Where a change materially disadvantages users, we’ll provide reasonable notice via the Website or email. Continuing to use the Services after the effective date means you accept the change.
11. Disclaimers
The Website and Services are provided “as is” and “as available.” To the extent permitted by law, we disclaim all warranties (merchantability, fitness for a particular purpose, non-infringement). We do not warrant that outputs will meet your expectations or that the Services will be uninterrupted, secure, or error-free.
12. Liability Limit
Nothing excludes liability for death or personal injury caused by negligence, fraud, or other liability that cannot be excluded by law. Subject to the foregoing, our total liability for direct losses arising from or related to the Services will not exceed the amount you paid for the specific request(s) giving rise to the claim in the preceding 12 months; we are not liable for indirect or consequential losses (including lost profit, data, or goodwill).
13. Indemnity
You agree to indemnify and hold harmless Pictora, its officers, employees, and affiliates from claims, losses, and expenses (including reasonable legal fees) arising out of: (a) your use of the Services; (b) your breach of these Terms; or (c) your prompts/outputs that infringe rights or violate laws.
14. Governing Law & Disputes
These Terms are governed by the laws of the Czech Republic. The courts of Prague have exclusive jurisdiction, without prejudice to mandatory consumer rights under applicable law.
15. Updates to These Terms
We may update these Terms from time to time. The “Effective Date” above shows when they last changed. Updates take effect upon posting on dreamai.design. Continued use after updates constitutes acceptance.
